29 CFR 1910.146(d)(3)(vi): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit entry operations, including, but not limited to, verifying that conditions in the permit space are acceptable for entry throughout the duration of an authorized entry: On or about August 1, 2025, and at times prior, on a site located at 4529 Hypoluxo Road, Lake Worth, Florida, the employer did not develop and implement the means, procedures, and practices to ensure that conditions in the permit-required confined space were acceptable throughout the duration of an authorized entry for employees exposed to hazardous chemical vapors such as, but not limited to Benzene, Toluene and Merican 9505 Unsaturated Isophthalic Resin when entering an underground fuel tank to perform a repair.
