29 CFR 1926.1412(d)(2): When any deficiency in paragraphs (d)(1)(i) through (xiii) of this section (or in additional inspection items required to be checked for specific types of equipment in accordance with other sections of this standard) is identified, an immediate determination was not made by the competent person as to whether the deficiency constitutes a safety hazard. When the deficiency was determined to constitute a safety hazard, the equipment was not taken out of service until it has been corrected: On or about June 24, 2025, and at times prior thereto, at Massey test site, the employer did not ensure the Grove RT9150E crane engaged in spaceship unexpected anomaly debris demolition was taken out of service when the crane computer would not start. The crane computer did not initially turn on until multiple attempts were performed by employees to set up the weight indicator and block selections.
