SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO THE HAZARD OF UNAUTHORIZED PERSONS IN THE MACHINE ROOM OF THE MAINTENANCE SHOP'S INCLINED ELEVATOR BEING EXPOSED TO ACCIDENTAL CONTACT WITH ENERGIZED ELECTRICAL PARTS AND BEING EXPOSED TO MOVING PARTS OF THE INCLINED ELEVATOR, INCLUDING THE POSSIBILITY OF BEING STRUCK BY THE ELEVATOR CAR ITSELF. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD IS TO LIMIT ACCESS TO THE MACHINE ROOM TO AUTHORIZED PERSONS ONLY BY PROVIDING A DOOR WHICH IS SELF-CLOSING AND SELF-LOCKING BUT OPENABLE FROM THE INSIDE WITHOUT A KEY. THIS DOOR WOULD BE CLOSED AND LOCKED WHEN NOT IN USE AND WOULD BE PROVIDED WITH A SIGN RESTRICTING USE TO AUTHORIZED PERSONS ONLY.
