OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to inadvertent mixing of incompatible chemicals from improper storage: a) Water Room- On or about March 21, 2025, the employer stored acids such as sulfuric acid 50% and nitric acid 38%, bases such as potassium hydroxide 45% and Chlorguard III (sodium carbonate), and oxidizers such as hydrogen peroxide 32%, ZeroTol 2.0 (hydrogen peroxide), and BioSide HS 15% (hydrogen peroxide), in the same spill containment and fire area exposing employees to inadvertent mixing of incompatible chemicals and generation of heat, toxic gases, pressure, interaction with other chemicals in the same fire area such as ammonium nitrate, or a combination thereof which can lead to burn or corrosive injuries, struck-by injuries, toxic injuries, or any combination thereof which could cause death or serious physical harm.
