29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person. Location: Worksite On or about March 19, 2025, employees were exposed to fall hazards of over 40 feet while erecting and dismantling the fabricated frame scaffolding used on site to perform the new copper downspout installation, where the employer did not ensure that trained employees erected and dismantled the scaffolding under the supervision and direction of a competent person. The employer has previously been cited for not ensuring that a competent person oversaw work, as noted below: a) JOHN WILLIAM MASONRY BRS, LLC was previously cited for a Repeat-Serious violation of this occupational safety and health standard or its equivalent standard, 1926.20(b)(2) which was contained in OSHA inspection number 1482471, citation number 2, item number 1 and was affirmed as a final order on 1-4-2021, with respect to a workplace located at 10 Charlesgate East, Boston, MA 02115. b) JOHN WILLIAM MASONRY BRS, LLC was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard, 1926.20(b)(2) which was contained in OSHA inspection number 1397997, citation number 1 , item number 1 and was affirmed as a final order on 9-18-2019, with respect to a workplace located at 121 Portland Street Boston MA.
