29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. a) On or about March 10, 2025, along Balch Road, Madison, AL; employees were performing work activities in various excavations without persona protective equipment (PPE) such as but not limited to hard hats when overhead work was ongoing and eye protection when performing construction work in when employees were exposed to flying debris, particles, or dust. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
