29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) Beside Access Road: On or about February 10, 2025 and times prior, an employee was replacing a section of sewer line in an excavation approximately 5 feet 5 inches deep and was not protected from materials falling into the excavation by the use of retaining devices or by keeping excavated materials at least 2 feet from the edge of the excavation. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.
