29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: At a structure under construction located at Lots 1430 and 1432 SW Winthrop Terrace, Lee's Summit, MO, employees were exposed to fall hazards. The employer exposed the employees to these hazards by allowing them to use a ladder to access an upper landing surface while the ladder's side rails did not extend at least 3 feet above the level to which it was being used to gain access.
