29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On December 12, 2024, the employer did not ensure its subcontractor protected its employees who were exposed to a fall hazard of approximately 11.7-feet while using a ladder to access the roof of a new construction commercial building. The top end of the ladder was resting against the eve of the roof and did not extend above the landing surface. (b) On December 12, 2024, the employer did not ensure its subcontractor protected its employees who were exposed to a fall hazard of approximately 11.7-feet while using a ladder to access the roof of a new construction commercial building. The ladder extended approximately 2.5-feet past the landing surface.
