29 CFR 1926.503(a)(2): Training program. The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: (i) The nature of fall hazards in the work area; (ii) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (iii) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; (vi) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and (vii) The role of employees in fall protection plans; (viii) The standards contained in this subpart. a) On or about October 3, 2024, at 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to ensure that Employee #1 received training in fall protection as required. Specifically, the employer did not train Employee #1 on the nature of fall hazards in the work area, the correct procedures for inspecting the fall protection system being used, the use and operation of personal fall arrest systems, and the applicable standards contained in Subpart M - Fall Protection. As a result, Employee #1 was exposed to a fall hazard while working on a roof approximately 15 feet above an asphalt driveway, ultimately leading to a fatal fall. b) On or about October 3, 2024, at 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to ensure that Employee #4 received training in fall protection as required. Specifically, the employer did not train Employee #4 on the nature of fall hazards in the work area, the correct procedures for inspecting the fall protection system being used, the use and operation of personal fall arrest systems, and the applicable standards contained in Subpart M - Fall Protection. As a result, Employee #4 was exposed to fall hazards while performing re-roofing activities without knowledge or preparation to mitigate those hazards. c) On or about October 5, 2024, at 2797 Shaffer Avenue, Cincinnati, Ohio, the employer failed to ensure that Employee #5 received training in fall protection as required. Specifically, the employer did not provide training on the nature of fall hazards in the work area, such as working at a height of approximately 14 feet above a hard asphalt surface, or the correct procedures for inspecting the fall protection system being used. Employee #5 was also not trained on the use and operation of personal fall arrest systems or the applicable standards contained in Subpart M - Fall Protection.
