29 CFR 1926.451(g)(1)(vii):Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) On or about May 18, 2024, at a worksite located at 2565 Georgia Ave NW, 1st floor, the employees were working on a scaffold system erected near an open elevator shaft. Employees were not protected from falling an estimated 35 feet while conducting masonry work. IN THE ALTERNATIVE: 29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest system a) On or about May 18, 2024, at a worksite located at 2565 Georgia Ave NW, 1st floor, employees were working on a scaffold system. They were erecting the scaffold above the guard railing, which exposed them to an estimated 35-foot fall hazard. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records
