29 CFR 1910.134(d)(3)(i): The employer shall provide a respirator that is adequate to protect the health of the employee and ensure compliance with all other OSHA statutory and regulatory requirements, under routine and reasonably foreseeable emergency situations. a.) On or about April 17th and 18th, 2024, the employer did not ensure respirators for use during a hazardous chemical spill of BASF Golpanol PA (Fatal Inhalant, Fatal Skin Contact, Flammable) were adequate in that employees were provided with and wore N95 filtering facepiece respirators and did not wear respirators with chemical cartridges.
