29 CFR 1910.178(l)(4)(ii)(A):Refresher training in relevant topics were not provided to the operator when the operator was observed operating a vehicle in an unsafe manner. On or about May 2, 2024, the employer failed to ensure that refresher training was provided to an operator who was observed operating a fork truck in an unsafe manner, thereby exposing employees to fall injuries. A supervisor observed an forklift operator lift an employee 10 feet in the air on a pallet and did not intervene. The operator was not retrained after this unsafe act was observed. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
