29 CFR 1926.62(g)(2)(vii)(A): The employer shall ensure that the containers of contaminated protective clothing and equipment required by paragraph (g)(2)(v) of this section are labeled as follows: DANGER: CLOTHING AND EQUIPMENT CONTAMINATED WITH LEAD. MAY DAMAGE FERTILITY OR THE UNBORN CHILD. CAUSES DAMAGE TO THE CENTRAL NERVOUS SYSTEM. DO NOT EAT, DRINK OR SMOKE WHEN HANDLING. DO NOT REMOVE DUST BY BLOWING OR SHAKING. DISPOSE OF LEAD CONTAMINATED WASH WATER IN ACCORDANCE WITH APPLICABLE LOCAL, STATE, OR FEDERAL REGULATIONS. (a) On or about 05/01/2024 at the MTA-F line a 2.10-mile-long elevated steel structure from Kings Highway above McDonald Ave/Shell Road/West 6th Street and West 8th Street, abrasive blasters and vacuum operators were permitted to place lead contaminated blasting suits and hoods into unlabeled trash bags. These unlabeled trash bags of contaminated protective clothing and equipment were permitted to be transported by vehicle for cleaning by the employer at another location. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
