29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form. Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH. On or about October 5, 2023, and at times prior thereto, the employer did not assess the respiratory hazards in the utility area during the application of an adhesive product mixture with chemical products such as, but not limited to, Dow Voramer ME 3044 Isocyanate and Dow Voramer MB 3099 Polyol, exposing employees to a chemical hazard.
