29 CFR 1910.132(a): Protective equipment was not used when necessary when a hazard of process or environment capable of causing injury or impairment of the body through physical contact was encountered. (a) Building 55, TPA Barn: On or about October 12, 2023, and times prior, the employer did not provide or require the use of flame-retardant and non-static generating clothing necessary to protect employees from burns due to potential flash fires and/or explosions in areas where combustible dust was present. (b) Building 55, CP3 West Pit: On or about November 14, 2023, and times prior, the employer did not provide or require the use of flame-retardant and non-static generating clothing necessary to protect employees from burns due to potential flash fires and/or explosions when working in areas where combustible dust is present.
