29 CFR 1910.178(q)(7): Industrial trucks were not examined daily prior to use or were not taken out of service after the examination showed condition(s) adversely affecting the safety of the vehicle: On June 6, 2023, and times prior, at or near 4409 33rd Street North West in Fargo, North Dakota employees were exposed to hazards associated with the operation of powered industrial vehicles where: (a) Powered Industrial Vehicles were not inspected daily to ensure safe operation, forklifts with deficiencies such as but not limited to; missing seat belts, inoperable horns, and excessively damaged tires were being operated. (b) Where sporadic inspections of the Powered Industrial Vehicles were performed and deficiencies were identified, the employer failed to tag out or remove the forklifts from service.
