29 CFR 1910.1018(g)(2)(i) as referenced in 29 CFR 1915.1018: A written program was not established, or implemented to reduce exposures to inorganic arsenic to or below the permissible exposure limit by means of engineering and work practice controls: Location: 100 Military Ocean Terminal Street. Bayonne, New Jersey 07002. a) The employer did not implement a written compliance program to reduce employees exposure to inorganic arsenic below the permissible exposure limit. On June 26, 2023 an employee performing abrasive sand blasting operations in a salt water storage tank was exposed to inorganic arsenic at concentrations of 35 micrograms per cubic meter of air, as an 8-Hour Time Weighted Average, exceeding the Permissible Exposure Limit (PEL) of 10 micrograms per cubic meter of air by 3.5 times. Zero exposure was assumed for the unsampled period of 230 minutes. Violation occurred on or around June 26, 2023.
