29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i). This violation was observed on or about April 17, 2023, at the facility, employees are not protected from falling off a dock that is 4 feet or more above a lower level, where guardrails or some other protective devices were not provided to protect employees from the hazard of falls. Pursuant to 29 CFR 1903.19, within (10) calendar days of the date of this citation, the employer must submit documentation describing the steps taken to ensure protection from falls is implemented to protect employees working on or near the dock.
