29 CFR 1910.28(b)(7): 29 CFR 1910.28(b)(7): openings. The employer did not ensure that each employee on a walking-working surface near an opening, including one with a chute attached, where the inside bottom edge of the opening is less than 39 inches (99 cm) above that walking-working surface and the outside bottom edge of the opening is 4 feet (1.2 m) or more above a lower level is protected from falling by the use of one of the systems listed in 29 CFR 1910.28(b)(7)(i)-(iv). Worksite located at 1323 W. Locust St. Springfield, MO.- Stairway from picking house near M5 area- Employees were exposed to fall hazards near the materials chute in which the bottom below the chute was not guarded as well as the area above the chute was not guarded to prevent employees from falling in the chute or below the chute.
