Text For Citation: 01 Item/Group: 003 Hazard:
29 CFR 1910.1200(f)(6): Workplace labeling. The employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked as required. On or about March 16, 2023, the employer did not ensure that each container of hazardous chemicals was labeled, tagged, or marked as required. There were multiple bottles that appeared to have been purchased with the original contents and then repurposed when empty for fill, mix, and transfer of unknown chemicals: (a) In the Fish DC, inside the Hazardous Chemicals storage room, there were 4 bottles that were originally Formacide-B and repurposed for a mixture of water and Malachite Green. These bottles were not properly labeled. (b) In the Fish DC, inside the Hazardous Chemicals storage room, there was a solid white spray bottle that was not properly labeled. (c) In the Fish DC, behind the large white tanks, there was a tote (appearance similar to a 5-gallon jug) sitting on top of a bucket turned upside down. The tote was filled with a green liquid, and the area surrounding the bucket was covered in what appeared to be the same green liquid that had partially solidified like a sludge or slime. The tote was not labeled. Employees are exposed to injury and illness such as chemical burns and respiratory hazards from unknown chemical exposure. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
