29 CFR 1910.134(e)(1): General. The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. a) Lowe' s retail store, 265 McLean Blvd., Paterson, NJ: On or about March 14, 2023, an employee used gas-powered saws to cut concrete, while another employee assisted by spraying water on the saw cuts to control dust. The work was done inside a plastic sheeting enclosure the employees built for the job. The employees were not provided medical evaluation when required to wear a P95 filtering facepiece respirators.
