29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a. On or about February 14, 2023, the employer did not ensure that powered industrial trucks/forklifts in operation throughout the facility were inspected and examined after each shift. An employee was operating a Toyota Counterbalance sit-down propane powered forklift (Model: 8FGCU25; Serial Number: C1554) that was missing a fire extinguisher, thereby exposing employees to fire-related hazards. b. On or about February 14, 2023, the employer did not ensure that powered industrial trucks/forklifts in operation throughout the facility were inspected and examined after each shift. An employee was operating a Toyota Counterbalance sit-down propane powered forklift (Model: 8FGCU25; Serial Number: C1536) that was missing a fire extinguisher, thereby exposing employees to fire-related hazards.
