29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: a. Located at the vicinity of 840 West State Street, Columbus, Ohio: On or about February 02, 2023, employees were working in a trench at depths greater than nine feet while performing a new sanitary line installation. Employees performed work in the unprotected area of the trench adjacent the trench shield in place, thereby exposed to crushed-by hazards. b. Located at the vicinity of 840 West State Street, Columbus, Ohio: On or about February 06, 2023, an employee was working in a trench at depths greater than nine feet while performing a new sanitary line installation. The employee performed work in the unprotected area of the trench adjacent the trench shield in place, thereby exposed to crushed-by hazards. Boss Excavating & Grading was previously cited for a serious violation of this Occupational Safety and Health standard 29 CRF 1926.652(a)(1), which was contained in OSHA inspection number 1446106, citation number 1, item number 2b and was affirmed as a final order on December 17, 2019 with respect to a workplace located at 9341 Jerome Road in Dublin, Ohio 43017.
