Text For Citation: 01 Item/Group: 003 Hazard:
29 CFR 1910.307(b): Areas designated as hazardous (classified) locations under the Class and Zone system and areas designated under the Class and Division system established after August 13, 2007 were not properly documented: (a) Green Waste Area - On or about February 1, 2023, the employer failed to classify a 40'x8'x8' intermodal shipping container (CONEX) as a hazardous location thereby exposing employees to explosion and fire hazards. The employer used the CONEX as enclosed, short-term storage for plant waste that had been saturated in butane. A spark was generated when an employee attempted to attach a portable space heater to an extension cord attached to an electrical outlet box mounted just inside the CONEX entrance. The electrical equipment provided was not rated for hazardous (classified) locations. The spark ignited flammable vapors and resulted in an explosion and fires within the CONEX. The CONEX and adjacent building were heavily damaged in the blast and the employee was hospitalized with burns to the hands and face. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
