Portable step ladders most have a metal spreader or locking device engaged to hold the front and back sections in an open position during use. a) On or about 01/12/2023, at the "Splash Car Wash" located on 40 Nichols Street, in Spencerport, New York, the employer did not enforce safe ladder use during the installation of exterior framing. The employer allowed employees to use a portable ladder designed to be used in an open position without using a locking device to keep the ladder in an open position and exposing them to falls. NO ABATEMENT CERTIFICATION REQUIRED
