29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access. a) On or about January 10, 2023, at the previously addressed inspection site, employees engaged in roofing activities including cleaning and clearing trash from the roof at heights greater than 6 feet accessed the roof by using a portable ladder that did not extend at least 3 feet above the roof landing surface exposing employees to falls. Beck Roofing, Inc. dba L.J. Beck Roofing & Guttering, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or a substantially similar Occupational Safety and Health Standard, 1926.1053(b)(1), which was contained in OSHA inspection number 1390067, citation number 2, item number 2 and was affirmed as a final order on 8-6-2019, with respect to a workplace located at Texas Roadhouse, 3830 NYS Route 31, Liverpool, NY, 13090.
