29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): (a) On or about December 6, 2022, the employer exposed employees to struck-by hazards in that the operator of the LULL Telescopic Forklift (Model #644D-34, S/N 00AL25W24-910) was not familiar with the equipment, had originally received training on the computer only, and has no renewal certification to operate this equipment. The uncertified operator was working in close proximity to others working on the residential property. Note: and as referenced by the note contained in 1926.602(d).
