29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about October 5, 2022, and at times prior thereto, at the residential construction site, the employer did not ensure employees were using the ladder side rails extended at least three (3) feet above the upper landing surface to access the roof, exposing employees to fall hazards. a. Employees were exposed to fall hazards when using the extension ladder placed next to the front door entrance of the home. b. Employees were exposed to fall hazards when using another extension ladder placed in the back yard of the home. Alejandro Amaya Sandoval was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1475648, citation number 001, item number 003, issued on June 5, 2020, and was affirmed as a final order on July 7, 2020, with respect to a workplace located at 6613 Barnes Road, Frisco, TX 75034. Alejandro Amaya Sandoval was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1562106, citation number 002, item number 002, issued on November 12, 2021, and was affirmed as a final order on December 6, 2021, with respect to a workplace located at 5108 Holy Springs Road, Denton, TX 76207.
