29 CFR 1910.134(k)(5)(ii): Retraining was not conducted when inadequacies in the employee's knowledge or use of the respirator indicated that the employee did not retain the necessary training or skill: (a) Envirite of Ohio, Inc. DBA US Ecology, on or about August 22nd, 2022, and at times prior, at the location of 2050 Central Ave SE, Canton, OH 44707: The employer required employees to wear respirators when working in the area known as the solids processing unit (SPU) but did not ensure that retraining was conducted when employees were observed routinely not using the respirators as required. The employer did not ensure the use of appropriate respiratory protection for employees potentially exposed to dangerous levels of hydrogen sulfide gas.
