29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval: On April 28, 2022, and times prior thereto, at this construction site an employee utilized an excavator with a modified bolt as a bucket retaining pin without the manufacturer's approval for this modification. The employer did not ensure modifications or additions to the excavator were made with the manufacturer's approval, exposing employees to possible struck-by hazards.
