29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: On 4/8/2022, employees of Brown Construction Company were installing storm water drainage pipes in a trench measuring approximately 80 feet long by five feet wide by eight feet deep at a jobsite located at 9999 Old Highway 60 in Dudley, Missouri. The employer did not ensure that a daily inspection was performed by a competent person on excavations/trenches when employee exposure was anticipated. Employees were working in the trench area exposed to engulfment hazards.
