29 CFR 1910.29(b)(1): The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D11 of this section). a) Processing Area, Exterior: On December 6, 2021, and at times prior, the employer exposed employees to fall hazards of approximately 10 feet in height, in that; a section of the top rail on the guardrail system around the star screen was missing as employees worked on the platform of the machine.
