29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD), 2009 Edition with Revision Numbers 1 and 2 incorporated, dated May 2012, FHWA: a) On or about 11/23/2021 at a utility project located along Genesee Road in East Concord, New York; employees hydro-excavating for new utility poles had placed their truck along the shoulder and partially in the east bound lane of the road. The employer did not follow MUTCD Section 6C.05.02 which stated, "When redirection of the road users' normal path is required, they shall be directed from the normal path to a new path", exposing workers on foot to struck by hazards from vehicular traffic. b) On or about 11/23/2021 at a utility project located along Genesee Road in East Concord, New York; employees hydro-excavating for new utility poles had placed their truck along the shoulder and partially in the east bound lane of the road. The employer did not follow MUTCD Section 6F.61.24 which stated, "A vehicle displaying an arrow board shall be equipped with high-intensity rotating, flashing, oscillating, or strobe lights", exposing workers on foot to struck by hazards from vehicular traffic.
