29 CFR 1910.157(b)(2): An emergency action plan meeting the requirements of 1910.38, which designated certain employees to be the only employees authorized to use the available portable fire extinguishers and which required all other employees in the fire area to immediately evacuate the affected work area upon the sounding of the fire alarm, was not developed and implemented. a) In building 308, throughout the facility, on or about November 18, 2021, and at times prior to, the employer failed to ensure that an emergency action plan was developed and implemented meeting the requirements of 1910.38, which designated certain employees to be authorized to use portable fire extinguishers and which required all other employees in the fire area to immediately evacuate the affected work area upon the sounding of the fire alarm. b) In building 610, throughout the facility, on or about November 18, 2021, and at times prior to, the employer failed to ensure that an emergency action plan was developed and implemented meeting the requirements of 1910.38, which designated certain employees to be authorized to use portable fire extinguishers and which required all other employees in the fire area to immediately evacuate the affected work area upon the sounding of the fire alarm. c) At the overflow building, throughout the facility, on or about November 18, 2021, and at times prior to, the employer failed to ensure that an emergency action plan was developed and implemented meeting the requirements of 1910.38, which designated certain employees to be authorized to use portable fire extinguishers and which required all other employees in the fire area to immediately evacuate the affected work area upon the sounding of the fire alarm.
