29 CFR 1910.146(c)(3): When the employer decided its employees would not enter permit spaces, the employer did not take effective measures to prevent its employees from entering the permit spaces. Location: a) Inside elevator pit of passenger elevator, ID: 3P871: On or about March 5, 2021, an employee entered an elevator motor room to retrieve a dropped phone which was located in the elevator pit. The elevator pit was a permit-required confined space, and the employer's in-place measures to prevent its employees from entering the elevator pit did not prevent him from doing so.
