29 CFR 1910.1053(e)(1): The employer did not establish a regulated area wherever an employee's exposure to airborne concentrations of respirable crystalline silica was, or could have been reasonably expected to be, in excess of the PEL. a) On or about December 02, 2020, throughout the facility, employees (Forklift Operator/Laborer) were exposed to Crystalline Silica in concentrations of 149mcg/m3 filling bags of gravel/sand/pebbles aggregate and stacking bags on a pallet without having an established regulated area. b) On or about December 02, 2020, at the Aggregate Filler machine, employees (Laborer) were exposed to airborne Crystalline Silica in concentrations of 176.3mcg/m3 while filling bags of gravel/sand/pebbles and stacking bags on a pallet without having an established regulated area. c) On or about December 02, 2020, at the Aggregate Filler machine, employees were (QC/Laborer) exposed to airborne Crystalline Silica in concentrations of 75.2mcg/m3 while filling bags of gravel/sand/pebbles and stacking bags on a pallet without having an established regulated area.
