29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s) (A) 7 Mosquito Lane-Main yard: Employee(s) were not prohibited from operating a Doosan vertical mast forklift that had significant damage to include but not limited to: Broken steering wheel, missing dashboard and gauges, no horn, broken lights, significant wear on seat, hole drilled in fork. Condition observed on or about January 23, 2020. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTICIATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
