29 CFR 1926.1101(f)(2)(i): The employer with a work operation covered by the asbestos standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace: a) 125-133 West 2nd Street, Plainfield, NJ 07060 - Outside lot Employee(s) of Black Dog Construction cleaned up construction debris containing between 70% and 75% chrysotile asbestos, without the employer having a competent person perform an assessment of anticipated exposure(s) and ensure that appropriate control measures were in place prior to the initiation of work presenting the hazard of asbestos exposure. Violation occurred on or about November 5, 2019 b) 202 Park Avenue, Plainfield, NJ 07060 - Inside bank building Employee(s) of Black Dog Construction cleaned and disposed of materials such as but not limited to asbestos tiling (VAT) and mastic which contained between 6% and 14% chrysotile asbestos, without the employer having a competent person perform an assessment of anticipated exposure(s) and ensure that appropriate control measures were in place prior to the initiation of work presenting the hazard of asbestos exposure. Violation occurred on or about November 5, 2019.
