29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work shift to employees when they were in their work area(s) (a) On and before November 15, 2019, employees exposed to grain dust, particulates not otherwise regulated, and phosphine, did not have Safety Data Sheets available to them during each work shift while they were in their work areas. The SDS/MSDS binder for the site were stored in the superintendent's office, distant from the bin floors, and kept locked at times. Additionally, the employer did not maintain in the workplace copies of the required GHS compliant safety data sheets for each hazardous chemical. This included maintaining outdated Material Safety Data Sheets (MSDSs) onsite in the Hazard Communication binder.
