29 CFR 1910.28(b)(3)(i): The employer did not ensure each employee was protected from falling through any hole (including skylights) that was 4 feet (1.2 m) or more above a lower level by one or more of the following: covers, guardrail systems, travel restraint systems, or personal fall arrest systems: The employer is failing to protect employees from fall hazards. This was most recently documented on or about July 3, 2019 at the Hatcher D-1 Well site of Merit Energy Company, located at Road 11 and Road L in Liberal, Kansas. Employees engaged in pumping unit maintenance activities at the cellar cover areas were exposed to fall hazards of approximately 7 feet 4 inches from the walking/working surface of the broken wooden cellar covers to the cellar below. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.
