29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: Railcar Cleaning Terminals: On or about May 10, 2019, and at times prior thereto, employees were exposed to chemical, fire, and explosion hazards, while conducting the de-heeling process inside railcar tankers containing chemical commodity such as, but not limited to, natural gas condensate and sweet crude oil without employer consistently ensuring employees followed the procedures of the written permit confined space program.
