29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) Backhoe Excavating, Inc. at 925 Camberly Drive, Windsor, CO 80550: On or before April 16, 2019, where the competent person found evidence of a situation that could result in possible cave-ins, including the lack of protective systems and water accumulation, the competent persons did not remove themselves from the excavation, and did not take prompt corrective measures to mitigate or eliminate these hazards. Two employees were installing a sewer line in a trench approximately 31 feet long, 5 feet wide, and approximately 14 feet deep, with near vertical walls in type B soil, without a trenchbox or shoring, and without adequate sloping or benching. The trench collapsed, resulting in the fatal injuries of two employees. This condition exposed employees to cave-in and struck-by hazards.
