29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) In the melting area of the 2462 Emerson Ave S location, employees were not enrolled in a Hearing Conservation Program when exposed to continuous noise levels at 128.0% (91.7 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 457 minute sampling period. Zero exposure was assumed for the 23 minute period not sampled. This violation was discovered on or about February 1, 2019. b) In the melting area of the 2462 Emerson Ave S location, employees were not enrolled in a Hearing Conservation Program when exposed to continuous noise levels at 126.1% (91.6 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 454 minute sampling period. Zero exposure was assumed for the 26 minute period not sampled. This violation was discovered on or about February 1, 2019. c) In the melting area of the 2462 Emerson Ave S location, employees were not enrolled in a Hearing Conservation Program when exposed to continuous noise levels at 94.55% (89.5 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 457 minute sampling period. Zero exposure was assumed for the 23 minute period not sampled. This violation was discovered on or about February 1, 2019.
