29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. The employer is failing to protect employees from struck-by and engulfment hazards associated with trenching and excavations. This was most recently documented on or about January 11, 2019 at or near Stable Road, Saint Louis, MO 63110, employees were replacing a concrete storm drain pipe in an excavation measuring approximately 7.5 feet deep X 6 feet wide. The competent person did not perform an adequate daily inspection of the excavation exposing employees to engulfment hazards.
