29 CFR 1926.1412(d)(1): A competent person did not complete a visual inspection before or during that shift. The inspection must consist of observation for apparent deficiencies. Taking apart equipment components and booming down is not required as part of this inspection unless the results of the visual inspection or trial operation indicate that further investigation necessitating taking apart equipment components or booming down is needed. Determinations made in conducting the inspection must be reassessed in light of observations made during operation. At a minimum the inspection must include the requirements outlined in 29 CFR 1926.1412(d)(1)(i) to (d)(1)(xiv): The employer is failing to protect employees from crushing and struck-by hazards associated with using a boom truck crane to lift and suspend loads. The most recent occurrence was evident during the inspection conducted on August 16, 2018 at the jobsite located at 5183 Rd V, Davenport, NE 68335. The employer is using a boom truck crane and failed to conduct a thorough inspection prior to using it for the day. A walk-around inspection was conducted; however, the inspection did not include the minimum items outlined in the standard.
