Text For Citation: 01 Item/Group: 003 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and fall hazards. a) Throughout the farm, on or about 10/24/2018: The employer allowed employees to operate powered industrial machinery, such as but not limited to: skid steers, without the required training and certification to assure safe use and worker competency. b) Throughout the farm, on or about 10/24/2017: An employee operated a skid steer, while another rode on the bucket, exposing the worker to struck-by and fall hazards of up to 6 feet. Among other feasible and acceptable means of abatement: Provide training and certify workers to comply with manufacturer operator's manual and NIOSH Publication Number 2011-128, Preventing Injuries and Deaths from Skid-Steer Loaders, which states that workers must be trained to read and follow manufacturer's procedures for operating and maintaining skid-steer loaders [AEM 2016].
