29 CFR 1910.140(d)(2)(ii): The employer did not ensure that personal fall arrest systems were rigged in such a manner that the employee could not free fall more than 6 feet (1.8 m) or contact a lower level. a) Warehouse: The employer did not ensure that fall protection, such as, but not limited to, the 3M Safelight LOPRO Shock Lanyard model 209712 used by employees when picking and stocking products from a three tiered racking system would prevent the employees from contacting a lower level in the event of a fall. The LOPRO Shock Lanyard was 6 feet long and had a shock absorber system that would allow the employee to fall to a lower level, on or about 6/21/17. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
