29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). Site- Employees working in an unprotected excavation with vertical sides between 5 feet and 6 feet 7 inches deep were not protected from a cave-in. On or about May 16, 2017 employees entered an unprotected excavation to level stone, set a precast concrete drainage header, and take measurements without cave-in protection. An employee working in the excavation was fatally injured when one of the side walls of the excavation collapsed.
