29 CFR 1910.29(b)(1): The top edge height of top rails, or equivalent guardrail system members, are 42 inches, plus or minus 3 inches, above the walking-working surface. The top edge height may exceed 45 inches, provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11): (a) Rutten Construction, Inc. 47862 US Highway 18 in Canton, SD 57013: On and prior to February 27, 2017 the exposing employer did not ensure the shop mezzanine pony wall had an appropriate top edge height. This condition exposed employees were to fall hazards of approximately 9 feet.
